Poland Adopts Age Verification Law

Poland has adopted a package of laws to restrict minors’ access to harmful online content, tighten age verification requirements for adult websites, and recommend the EU Digital Identity (EUDI) Wallet for privacy-preserving age checks, according to Biometric Update.

The legislation is technology-neutral, but government officials have explicitly pointed providers toward the wallet’s built-in age verification, arguing that users should be able to prove they are old enough without handing over additional personal data. “It’s a mechanism that confirms age without revealing any personal data,” said Deputy Minister of Digital Affairs Dariusz Standerski. Under the approach, the service provider learns only that a user meets the age threshold, while the wallet issuer has no visibility into which sites or services requested the check, a separation designed to satisfy both child-protection rules and data-minimisation principles.

Poland plans to launch secure, anonymous age verification by the end of 2026 through its national digital identity ecosystem. Officials have indicated the capability could be built into mObywatel, the country’s digital identity app, which already serves around 12 million people, giving the scheme a large, established user base from day one rather than asking citizens to adopt an entirely new tool.

The move is one of the clearest signals yet of how European governments intend to use the EUDI Wallet for age assurance. It builds on the European Commission’s own age verification app, unveiled in April 2026 as a transitional “mini-wallet” that lets users prove their age ahead of the full wallet rollout. Both rest on the same selective-disclosure model, in which a cryptographic proof confirms that a user clears an age threshold without exposing their date of birth or wider identity. Under eIDAS 2.0, every member state is required to offer at least one EUDI Wallet by 6 December 2026, although some observers doubt all 27 will meet the deadline.

Poland’s law also stands against a tightening European backdrop. The Digital Services Act requires platforms to put proportionate measures in place to protect minors, and the Commission has opened proceedings against several major adult sites over weak age controls. Individual member states have moved independently too — France has issued stricter rules for pornography sites, and Spain has piloted a digital-wallet age check, adding pressure for a common, interoperable standard rather than twenty-seven divergent ones.

The wider Polish package goes beyond age verification, adding measures to accelerate the removal of illegal online content and introducing restrictions on smartphone use in primary schools as part of a broader child online safety drive.

For platforms preparing for this shift, wallet-based checks are likely to sit alongside the verification methods they already use rather than replace them overnight.
